[2] MWL Contest Rules & Conditions
Rules: 1.By participating in the MWL MGM and Friend contest, you are deemed to have agreed to the GSMA MWL MGM contest rules and conditions set forth below.
2.The MWL MGM Member and Friend contest (the “Contest”) will be open for entries from 12.01am EST January 21, 2014 through 23.59 EST February 5, 2014 (the “Contest Duration”), after which time the Contest will be closed and no further entries allowed. To enter the Contest, Entrants must submit online through the Mobile World Live Member Get Member Electronic Direct Mail (“MWL MGM EDM”) or through the Mobile World Live Member Get Member Friend EDM (“MWL MGM Friend EDM”). Entrants may enter the Contest as many times as they wish during the Contest Duration but must provide legitimate new referrals during each submission.
3.The Contest and these Rules and Conditions shall be governed by and construed in accordance with the laws of the state of Georgia, without reference to its conflicts of laws principles, as applicable. Any and all disputes, claims, and causes of action with the Challenge arising out of or connected with this Challenge, shall be resolved individually, and exclusively by the courts located in Atlanta, Georgia, applying Georgia law. Employees and contractors of GSMA, and its parent and affiliate companies as well as the immediate family members (spouse, parents, siblings and children) and household members of each such employee and contractor are not eligible to participate. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and decisions, which are final and binding in all matters related to the Contest.
4.Each instance of an Entrant’s submitting an official entry in MWL MGM EDM or MWL MGM Friend EDM contest counts as an entry in the contest (an “Entry”). For the MWL MGM EDM contest, with each Entry, the Entrant must provide 3 to 5 legitimate new referrals, with a name, and valid email address, for each referral, via the MWL MGM EDM. For the MWL MGM Friend EDM contest, the Entrant must subscribe to the MWL e-newsletter with name, and email address via the MWL MGM Friend’s EDM. At the conclusion of the Contest Duration, one (1) winner will be randomly selected by GSMA for MWL MGM Contest; and one (1) winner will be randomly selected for the MWL MGM Friend’s Contest.
5.GSMA’s selections shall be final and may not be appealed.
6.GSMA assume no responsibility for lost, late, delayed, damaged, incomplete, illegible, unintelligible, inaccurate, misdirected, non-compliant or postage due entries or for any computer, online, telephone or technical malfunctions that may occur.
7.Each Entrant must be the Authorized Account Holder of the email account submitted to GSMA for both the MWL MGM Contest and the MWL MGM Friend’s Contest. Authorized Account Holder is defined as the natural person who is assigned to an email address by an Internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain name associated with the submitted email address. In the event of a dispute over the identity of an Entrant, an Entry will be deemed to be submitted by the Authorized Account Holder of the email account.
8.GSMA is not responsible for any technical problems related to an Entrant’s device or otherwise that may prevent Entrant from participating in and/or completing the contest.
9.Prizes are as follows: For the MWL MGM Contest: one (1) Grand Prize of Two (2) Gold Passes for GSMA Mobile World Congress (MWC) 2014. For the MWL MGM Friend Contest: one (1) Grand Prize of an iPad Air or a comparable device to be selected at GSMA’s sole discretion.
10.Winners will be notified and contacted no later than February 13, 2014 at the "sender" email provided by the Entrant to enter the contest. In the event of a dispute as the identity of the winner, the account holder of the email address associated with the winning Entrant will be deemed the winner. Claiming of prizes requires an email to promotions@mobileworldlive.com from the winning Entrant’s sender email address within 7 days of his or her being notified of winning. Failure to respond shall mean that the selected winner forfeits the prize. In such event, GSMA may, but shall not be required to, award to the forfeited prize to another Entrant. GSMA will email the contest prize to the email address supplied by the winning Entrant. The two Gold Passes for MWC 2014 will be available to collect at the registration desk at GSMA Mobile World Congress, Barcelona. GSMA is not responsible for lost or stolen prizes. Winners will be publically announced no later than 20 February 2014 through the Mobile World Live Website.
11.Each recipient of a Prize is responsible for ensuring compliance with all applicable laws and regulations, including, without limitation, any applicable tax filing requirements.
12.Prizes cannot be redeemed for cash or other substitute prizes. THE GSMA’S LIABILITY FOR ANY AND ALL CLAIMS ARISING IN CONNECTION WITH THE CONTEST, UNDER ANY LEGAL THEORY, SHALL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). IN NO EVENT SHALL GSMA BE LIABLE FOR ANY LOSS OF DATA, LOST PROFITS, BUSINESS INTERRUPTION, OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, INDIRECT, OR SPECULATIVE DAMAGES.
13.GSMA retains the right, in its sole discretion, to terminate the contest or amend the rules of the Contest at any time.
14.Conditions: Contest entrants must be 18 years of age or older and reside in a country which is not embargoed from trading with the United States of America. No purchase or payment is necessary to participate in the Contest. Void where prohibited by law.
